Agricorp has established a dispute resolution process to guide you through disagreements. To initiate the dispute resolution process, contact Agricorp. If the internal review process does not resolve your concern, and you and Agricorp continue to disagree over a decision, you can pursue other options. For disagreements over claim decisions, you have the option of a mediation process or you can appeal through the Agriculture, Food and Rural Affairs Appeal Tribunal.
Mediation process (for claim decisions only)
A mediation process is available for disputes about claim decisions. The mediation process includes facilitated meetings where a mediator helps you and Agricorp try to resolve any disagreements over a final decision on a claim, with the goal of reaching a binding settlement.
You and Agricorp will decide on the mediator. The cost of the mediator's service is shared equally between you and Agricorp. Any additional costs related to the mediation beyond the costs of the mediator's services are the responsibility of the party incurring them. If you choose to retain legal counsel to assist you, those costs are at your own expense.
You must submit a request for mediation within 30 days from the day you received Agricorp's final decision.
Your choice to enter into mediation does not affect your right to proceed with an appeal through the Agriculture, Food and Rural Affairs Appeal Tribunal if the mediation is unsuccessful or if you decide to end the mediation before agreement is reached.
You can submit an appeal to the Agriculture, Food and Rural Affairs Appeal Tribunal. The Tribunal is an independent body that makes final decisions on disputes between Agricorp and Production Insurance customers.
You must file your appeal within one year from the day you received Agricorp's final decision. The decisions of the Tribunal are binding.
